제3조 (인간의 존엄과 가치) 건강과 혼인 및 모성보호, 가족생활 등을 비롯한 개인의 존엄과 가치에 관계된 사항은 연구와 학업에 절대적으로 우선하며, 어느 누구도 연구와 학업을 이유로 개인의 존엄과 가치를 훼손하는 행위를 하여서는 아니된다.
제4조 (평등권) 모든 대학원생은 성별, 국적, 인종, 연령, 장애, 종교, 임신과 출산, 정치적 또는 개인적 성향 등을 포함한 일체의 비합리적이거나 자의적인 사유를 근거로 차별당하지 않을 권리가 있다.
제5조 (학업 및 연구에 대한 권리) ① 대학원생에게 정당하게 보장된 학업과 연구의 기회는 부당하게 박탈되어서는 아니되며, 모든 대학원생은 학위과정을 마칠 때까지 정당하지 않은 이유로 학업이 중단되지 않을 권리를 가진다.
② 모든 대학원생은 전공과 연구주제 분야에 대하여 대학원 및 지도교수와 기타 학내 인적자원으로부터 필요한 시기에 충분하고 적절한 학문적 지도 및 조력을 받을 권리를 가진다.
③ 모든 대학원생은 학업과 연구 수행에 필요한 범위 내에서 학내 연구 공간 및 지원시설을 정당한 절차에 따라 이용할 권리가 있다.
제6조 (공정한 평가를 받을 권리) ① 모든 대학원생은 자신의 학업 및 연구결과에 대하여 정당한 절차와 객관적 기준에 기초한 공정한 평가를 받을 권리가 있다.
② 모든 대학원생은 자신의 학업 및 연구결과에 대한 평가에 공정성이 결여되어 있다고 의심되는 경우 평가자에게 이의를 제기할 수 있으며, 평가자는 이에 대해 충분히 설명하여야 한다.
제7조 (지식재산권) ① 모든 대학원생은 연구 아이디어 제공, 연구 과정 참여 등 자신이 적극적으로 기여한 연구출판물에 공저자로 등록될 권리가 있다.
② 모든 대학원생은 학계에서 일반적으로 받아들여지는 자신의 주도적이고, 독창적인 아이디어와 연구방법을 기반으로 한 연구결과에 대해 관련법에 따라 주저자로서의 저작권 등을 포함한 지식재산권을 가진다.
제8조 (사생활의 자유와 거부권) ① 모든 대학원생은 사생활의 자유를 가지며, 학업과 연구를 위해 반드시 필요한 경우를 제외하고는 이를 보장 받을 수 있다.
② 모든 대학원생은 신체적, 언어적, 성적 폭력으로부터 자유로운 환경에서 학습하고 연구할 권리가 있으며, 자신의 학업 및 연구와 연관성이 없고 사회통념에도 위배되는 부당한 요구에 대해서는 이를 거부할 권리를 가진다.
제9조 (건강과 휴식 및 안전에 대한 권리) ① 모든 대학원생은 건강한 신체와 정신을 향유할 권리가 있으며, 필요시에는 적시에 충분하고 적정한 치료를 받을 수 있어야 한다.
② 모든 대학원생은 건강하고 지속적인 연구활동을 위하여 충분하고 적절한 휴식을 취할 권리를 가진다.
③ 모든 대학원생은 안전한 환경에서 연구할 권리를 가지며, 대학원은 안전한 연구환경 조성을 위해 필요하고 충분한 조치를 취해야 할 의무가 있다.
제10조 (조교활동에 대한 권리) ① 모든 대학원생은 대학원이 대학원생을 교육조교, 연구조교, 연구과제 연구원 등의 근로학생으로 채용하는 경우, 대학원으로부터 근로시간, 근로내용, 장학금 등의 관련 정보를 사전에 제공받을 권리가 있다.
② 대학원은 투명하고 공정한 절차에 따라 객관적인 기준에 근거하여 조교 등의 근로장학생을 채용하여야 한다.
③ 대학원은 근로활동에 대해 사전에 제공한 근로시간, 근로내용, 장학금의 금액을 근로기간 중에 부당한 이유로 변경하여서는 아니된다.
제11조 (표현의 자유) 모든 대학원생은 헌법이 보장한 기본권에 기초하여 학내와 사회에 대한 개인의 의견을 자유롭게 표현할 자유를 가진다.
제12조 (알권리) ① 모든 대학원생은 본인이 참여하는 연구과제의 예산 및 지출 등 재정운용상황과 관련법이 정한 범위 내에서 공개되는 대학원의 재정운용 상황에 대해 알권리를 가진다.
② 학업 및 연구와 관련된 대학원의 결정과 그 세부사항은 투명하고, 이해하기 쉽게 공개되어야 한다.
제13조 (구성원으로서의 참여권) ① 모든 대학원생은 교수, 교직원과 함께 카이스트 대학원 공동체의 평등한 구성원으로서 존중받을 권리가 있다.
② 모든 대학원생은 대학원 자치조직을 구성하고 참여하거나 운영할 권리를 가지며, 학업 및 연구와 관련된 대학원의 의사결정과정에 의견을 개진하고 반영할 수 있다.
③ 모든 대학원생은 본 권리장전에서 명기된 권리들이 구체화되고 실현되는 과정에 주도적으로 참여할 수 있는 권리를 가진다. |

Article 3 (Human Dignity and Values)
Events related to individual’s dignity and values such as health, marriage, maternity protection, and family activities take absolute priority over research and studies, and no one shall violate human dignity and values for research or studies.
Article 4 (Right to Equality)
All graduate students have the right to be treated equal and not discriminated on the basis of any irrational or subjective reason such as their gender, nationality, race, age, disability, religion, pregnancy and childbirth, and political or individual disposition.
Article 5 (Right to Studies and Research)
1. Opportunity to study and research that has been rightfully secured to graduate students shall not be unfairly deprived from them, and all graduate students have the right to complete their study uninterrupted by any unfair reason.
2. All graduate students have the right to receive adequate and timely academic mentorship from the graduate school, faculty advisor, and other human resources about their major and research topic.
3. All graduate students have the right to use the research space and other support facility within the campus following appropriate procedures if required by the scope of their studies and research.
Article 6 (Right to Fair Evaluation)
1. All students have the right to fair evaluation of their studies and research based on unbiased procedure and objective standards.
2. All graduate students may raise objection to the evaluator if they suspect lack of fairness in the evaluation of their studies or research. In such an event, the evaluator must provide sufficient explanation.
Article 7 (Right to Intellectual Property)
1. All graduate students have the right to be listed as the co-author on research publications in which they actively participated to provide ideas or to conduct research.
2. Based on relevant laws and regulations, all graduate students have the right to intellectual property generated from research that they proactively participated and provided their unique idea and methodology to an extent generally recognized in the academia, including the copyright as the main author.
Article 8 (Right to Privacy and Denial)
1. All graduate students have the right to privacy, which shall be guaranteed except for when its compromise is absolutely necessary for their study or research.
2. All graduate students have the right to study and research in an environment free from physical, verbal, and sexual violence. They have the right to deny requests that are unrelated to their study or research and also violate the social norms.
Article 9 (Right to Health, Rest, and Safety)
1. All graduate students have the right to healthy body and mind, and shall be treated appropriately in a timely manner when required.
2. All graduate students have the right to adequate rest in order to continue research in a healthy state.
3. All graduate students have the right to research in a safe environment, and the graduate school is responsible for taking sufficient measures to ensure safe research environment.
Article 10 (Right to Assistant Activities)
1. All graduate students, when they are employed by the graduate school as student workers as teaching or research assistants, have the right to be provided relevant information such as the working hours, job description, and scholarship prior to start of work.
2. The graduate school shall select student workers based on transparent and fair procedure and objective standards.
3. The graduate school shall not change the working hours, job description, or scholarship amount that has been notified to a student worker due to improper reason.
Article 11 (Right to Freedom of Speech)
Based on the fundamental rights guaranteed in the constitution, all graduate students have the freedom to express their opinions about the school and the society.
Article 12 (Right to Know)
1. All graduate students have the right to know the status of financial management of the research project they are involved in, such as the budget and expenditures, and of financial management of the graduate school to the extent prescribed by the relevant laws and regulations.
2. Decisions made by the graduate school with regard to its programs and research must be made available to graduate students in a transparent and easily comprehensible manner.
Article 13 (Right to Participation)
1. All graduate students have the right to be respected as equal members of the KAIST graduate school community along with the faculty and staff.
2. All graduate students have the right to organize or participate in an independent group within the graduate school, and may express their opinion and work to reflect their opinion on the decision-making process of the graduate school related to its program and research.
3.All graduate students have the right to actively participate in the realization of the rights specified in this Bill of Rights. |
