[탐사플러스] ‘전과도 알 수 없어’…불법체류자 문제 심각
이렇게 우범자들을 걸러내지 못하는 정책 때문에 선의의 외국인들과 중국 동포들까지 피해를 입고 있습니다. 저희 취재진이 외국인 밀집 거주지역에서 경찰과 동행해 실태를 파악해 봤는데요. 전혀 예상치 못한 결과들이 많이 나왔습니다.

경기도 안산시 원곡동입니다.
한글보다 중국어로 쓰여진 간판들이 더 눈에 띕니다.
외국인 거주자가 많이 살아 일명 ‘국경없는 마을’로도 불립니다.
최근 수원 토막살인 사건처럼 외국인 강력범죄가 늘면서, 주민들 불안감도 그 어느 때보다 높습니다.
취재진은 경찰과 실태를 직접 점검해 보기로 했습니다.
지난 19일 오후 원곡동 다문화 지구대입니다.
중국 동포 10여명이 줄줄이 지구대로 들어옵니다.
주택가에서 중국 도박인이 마작을 하다 적발된 겁니다.
[경찰 관계자 : 인적 사항이 없는 사람이 있어요. 최OO 씨, 신분증 있어요? (없어요.)]
일부 중국 동포는 외국인 등록증도 소지하지 않고 있었습니다.
[외국인 거주자 : 친구가 가져올 겁니다.]
한 중국 동포는 단기 방문비자로 체류하다 도박판에 참여했습니다.
[김명철 팀장/원곡 다문화 지구대 : 대부분 그런 사람들이 윤락으로 빠져요. 다방이라든가, 도우미라든가. 그래서 불법체류자가 되는 거예요.]
취재진은 경찰과 함께 직접 거리에서 불법 체류 실태도 파악해 봤습니다.
경찰이 불심 검문을 벌이자, 외국인이 인근 가게로 몸을 숨깁니다.
이를 발견한 경찰이 쫓아가 신분 확인을 요구합니다.
[경찰 관계자 : 불법체류자 맞아요? 아니에요? 체류기간 지났어요? 안 지났어요?]
이 외국인은 자신의 이름과 생일도 모른다고 말합니다.
[외국인 거주자 : (일단 본인 이름하고 생일 적어보세요.) 잠깐만요.]
결국 지구대로 연행됩니다.
[경찰 관계자 : 변호사를 선임할 수 있어요. 파출소 갔다가 확인만 하면 돼요.]
지구대에서 통역을 통해 알려준 자신의 이름도 가짜였습니다.
[경찰 관계자 : 불러준 거 확인해 보니 얼굴이 달라서 불법체류자 같습니다.]
출입국 관리소에 확인한 결과, 이 외국인은 2008년 비자가 만료된 불법체류자였습니다.
[불법체류자 : (한국에 몇 년 됐어요?) 4년. (한국 어디에서 일했어요?) OO타운. (처음 말한 이름과 본인 이름이 달랐잖아요?) 몰라요.]
그 사이 다른 외국인이 지구대에 들어옵니다.
술에 취해 제대로 몸도 가누지 못합니다.
경찰이 신분증을 확인한 결과, 불법체류 신분의 중국 동포였습니다.
[신동권 경사/원곡 다문화 지구대 : (취객) 보호 차원에서 파출소로 데려와 신분증을 확인했는데 체류 기간이 지난 불법체류자로 확인됐습니다.]
국내 거주 외국인은 매년 늘어 지난 11월 현재 177만명에 달합니다.
이 중 10%가 넘는 20만명이 불법 체류자로 꼽힙니다.
박춘봉처럼 여권을 위조해 적발된 사례도 매년 4000~5000건에 이릅니다.
이웃나라 일본의 20배 수준입니다.
[차규근 변호사/법무법인 공존 : 예전엔 모든 외국인에 대해 입국 시 지문을 채취하는 제도가 있었는데 2000년도 초반에 없어졌습니다. 2012년 다시 도입이 됐습니다.]
문제는 불법체류자들이 모국에서 저지른 범죄 경력이 전혀 파악되지 않는다는 겁니다.
2012년 희대의 살인 사건으로 검거된 오원춘도 마찬가지입니다.
오씨가 중국에서 저지른 폭행, 도박, 문서위조 등 범죄는 결국 본인 자백을 통해 밝혀졌습니다.
[정상환 변호사/당시 수원지검 검사 (2012년 4월) : 오원춘은 중국에서 폭력, 도박, 문서위조로 처벌 받았다고 진술했습니다. 그러나 중국에서 공식적으로 받은 자료엔 전과 기록이 나타나지 않습니다.]
중국 동포를 대상으로 하는 일부 여행사와 브로커들은 허술한 출입국 관리 시스템을 악용하기도 합니다.
[출입국 브로커 관계자 : 선대 할아버지가 한국 사람인 것만 증명되면 한국 국적이 나온단 말이야. 법무부에 (위조 중국 호적을) 제출하면 법무부에선 확인을 안 하고.]
일각에선 불법체류자의 일부 엽기적인 사건이 외국인 혐오증으로 번져선 안된다는 목소리도 제기됩니다.
[이수정 교수/경기대 범죄심리학과 : 조선족 두 사람의 사건만 가지고 모든 외국인들이 위험하다는 것은 잘못된 과잉 일반화의 오류라고 보여집니다.]
당국의 대책이 늦어질수록 제2의 오원춘, 박춘봉이 얼마든지 나타날 수 있습니다. |

Good will foreigners and Chinese Korean migrants have suffered from losses and damages because of the government’s policy that does not screen habitual criminals. A lot of results not expected have been produced.

Signs in the Chinese language have been shown more than the ones in the Korean language do.
The town is sometimes called ‘town without border’ where a lot of foreigners live lives.
Recent case of Suwon torso murder and other violent crimes made residents feel uneasy than before.
The reporters have investigated the police and actual conditions.
In the afternoon on the 19th days, here is Wongok-dong Multi-cultural Petrol Division.
More than ten of Korean Chinese migrants have entered the petrol division.
They were detected when playing mah-jong at residential area.
[Concerned person of the police: Someone has no personal information. Choi OO, Have you identification? (No, I have not)]
Some of Korean Chinese migrants had not kept certificate of alien registration.
[Foreigner resident : A friend of mine shall bring it]
A Korean Chinese migrant who resided in Korea with short-term visit visa joined gambling.
[Team leader Kim Myeong-cheol / Wongok Multi-cultural Petrol Division : Most of them had been fallen into prostitution, for instance, coffee shop lady, Doumi (guide). They become illegal migrants.
The reporters inspected situation of illegal migration at the street together with the police.
At the police’s random questioning, foreigners hid them in neighboring shops.
The policeman who had watched the scene traced the foreigner asked to show identification.
[Policeman : Are you illegal migrant? Or, not? Does your immigration expire? Or, not?]
The foreigner said that he did not know name and date of birth.
[Foreigner migrant : (Fill out your name and date of birth) Wait a moment.]
At last, he was brought to petrol division.
[Policeman : You are allowed to nominate a lawyer. You shall be brought to police fox for me to identify you]
The foreigner’s name that an interpreter informed Petrol Division was fake.
[Policeman : I have identified your name to find out difference of face. You looks to be illegal migrant.]
At identification at immigration checkpoint, the foreigner was found to be illegal migrant whose visa expired in 2008.
[An illegal migrant : (How long have you been in Korea?) 4 years. (Where did you work in Korea?) OO Town. (Your name that you told us differed from your own name, isn’t it?) I do not know.]
On the other hand, another foreigner entered Petrol Division.
The drunken foreigner could not keep balance.
At the police’s inspection into identification, the foreigner was illegal Korean Chinese migrant.
[Police sergeant Shin Dong-gwon / Wongok Multi-cultural Petrol Division : I brought the drunken person to protect him and to inspect his identification. He was found to be illegal migrant.]
Foreigners in Korea have increased year by year to reach 1.77 million person as of last November.
10 percent of them, in other words, 200,000 persons are thought to be illegal migrants.
Number of cases of forge of passport like Park Chun-bong was 4,000 to 5,000 each year.
The number was 20 times that of Japan.

Criminal history of illegal migrants in their home country has not be detected at all.
The case of Oh Won-chun arrested at murder in 2012 can be applied.
Oh’s crimes of violence, gambling, document forgery and others in China were disclosed at his confession.
[Lawyer Jeong Sang-hwan / prosecutor at Suwon District Prosecutor’s Office in April 2012] : Oh Won-chun said that he was punished at violence, gambling and document forgery in China. But, official document from the Chinese government did not disclose previous crimes.]
Some of travel agents and/or brokers for Korean Chinese migrant made bad use of insufficient immigration control system in Korea.
[Immigration broker : Evidence of the Koreans of grandfather in previous generation releases certificate of Korean nationality. The Ministry of Justice does not identify fake of the family register in China.]
Some persons say that illegal migrant’s grotesque murder case should not trigger xenophobia.
[Professor Lee Su-jeong / department of criminal psychology, Kyonggi University : Thought that all of foreigners are dangerous by two of Korean Chinese migrants seems to be wrong and excessive.]
The authority’s late measure may produce another case of Oh Won-chun and Park Chun-bong. |
