3. Subscriptions
3.1. Institutional Subscriptions
“Institutional Subscriptions” shall mean subscriptions sold throughout the world to academic, medical, corporate, and other institutional libraries and other subscribers throughout the world. Institutional Subscriptions to the Journal shall include all regular issues of the Journal and any supplements. The Publisher shall be responsible for setting the annual Institutional Subscription rate.
3.2. Society Member Subscriptions
The Society is wholly responsible for the printing and distribution of printed copies to Society members. To facilitate this, the Publisher shall provide the Society with print-ready pdf files. In addition, the Publisher shall also provide to the Society free access to the electronic edition of the Journal through the Publisher’s online information portal currently known as SpringerLink (or such other electronic format or system designated by the Publisher from time to time) for each active Society member. Society Member Subscriptions to the Journal shall include all regular issues of the Journal and any supplements.
4. Ownership of Intellectual Property
a. The Society shall own the Journal and all trademarks, and other proprietary rights in the Journal and all other names or symbols supplied by the Society to identify the Journal, except as provided in Subsection 4(c).
b. As between the parties, the Society shall own the copyright in all articles and Society-provided commentary contained in the Journal.
c. Nothing in this agreement shall be construed to give the Society a claim to ownership of any intellectual property owned or provided by the Publisher or third parties and used in, or in conjunction with, the Journal.
d. The Publisher shall, at its expense and in the name of the Society, register claims to copyright for each issue of the Journal throughout the world, and shall print proper notice of copyright in each issue of the Journal. Each copyright notice shall indicate that the copyright is held by the Society, and shall otherwise be in conformance with the Universal Copyright Convention (UCC). The Publisher will assign and register the Journal’s articles digital object identifiers (DOI).
5. Rights Granted
a. The Society grants to the Publisher from Volume 58 (2015) the exclusive right and license to produce, publish, archive, translate and sell the Journal in all anguages, all forms and all media now known or later devised or perfected, throughout the world, for the term of this agreement.
b. Subject to the terms and conditions of this agreement, the Society hereby grants to the Publisher, for the term of this agreement, the exclusive license to use the name of the Society, the title of the Journal, and any trademarks, trade names or logotypes associated with them in connection with the exercise of any rights granted to the Publisher in this agreement and reasonably exercised in the pursuit of its rights as the publisher of the Journal.
c. The Society reserves a non-exclusive right to reproduce from time to time, in print and electronic form, Society news, commentary and other material, but not peer-reviewed articles, that previously may have been published in the Journal. The Society will not use that material in a manner that might divert revenue from the Journal or otherwise impair the Publisher’s ability to market the Journal as a part of its worldwide publishing program, nor will the Society seek third-party funding for, or any third-party participation in, the distribution of that material without the Publisher’s approval, which shall not to be unreasonably withheld.
d. The Society grants to the Publisher the right to print single issues of material for which the Publisher does not have stock, in order to fulfil claims ofvalid subscribers, to fulfil back orders for historical volumes, etc.. Revenues generated from these sales will be included in Net Revenues as defined in Section 16.
e. Digital Preservation Entities: Parties agree that the Publisher is entitled to entrust digital preservation entities such as Portico (www.portico.org) – or any other repository of similar nature or co-operating with other companies developing new forms of archiving later devised or perfected – to archive the content of the Journal published during the term of the Publishing Agreement.
6. Subsidiary Rights
The Publisher shall have the exclusive right to license, to any third party, the right to exercise, in all forms and formats now known or later devised or perfected, any subsidiary rights associated with the Journal, including, without limitation, the right to translate, into any language, authorize, excerpt, and adapt the Journal in whole or in part. The Publisher shall take reasonable commercial efforts to select, as sub licensees exercising any of the foregoing rights, entities that will maintain a high quality standard. The Publisher will advise the Society, upon request, of the exercise of any of the foregoing rights.
7, Competing Works
a. The Society will not, during the term of this agreement, enter into new affiliations with other professional journals or trade magazines, or otherwise engage officially in the publication of any peer-reviewed, professional journal or magazine, that, in the Publisher’s judgment, might directly conflict with or compete with the successful publication of the Journal.
b. To the extent it is legally able to do so, during the term of this agreement, the Society shall not permit the editor-in-chief of the Journal to serve in a similar capacity for a journal of similar content or character published by any party other than the Publisher. The Publisher acknowledges, however, that the editor-in chief of the Journal may serve on the editorial boards of other journals.

3. 구독
3.1 단체 구독
“단체 구독”은 전 세계의 대학 도서관, 의학 도서관, 기업 도서관, 기타 단체 도서관 등과 기타 구독자에게 판매된 구독권을 의미한다. 저널이 단체 구독되는 경우 저널과 부록의 모든 정기 발행물이 함께 제공 되어야 한다. 출판사는 연간 단체 구독료를 설정할 책임을 진다.
3.2 학회 회원 구독
학회는 인쇄물을 간행하여 학회 회원에게 배포해야 할 전적인 책임을 진다. 출판사는 이러한 업무가 용이하게 실행될 수 있도록 즉시 인쇄 가능한 pdf 파일을 학회에 제공해야 한다. 또한 출판사는 학회의 각 활동 회원을 위하여 SpringerLink로 알려진 출판사의 온라인 정보 포털 (또는 출판사가 수시로 지정하는 기타 전자 서식 또는 시스템)을 통해 이용 가능한 저널 전자판 무료 접속권을 학회에 제공해야 한다. 학회 회원이 저널을 구독하는 경우 저널과 부록의 모든 정기 발행물이 함께 제공 되어야 한다.
4. 지적 재산의 소유
a. 학회는 저널 및 모든 상표는 물론 저널에 관한 재산적 권리, 저널을 식별하기 위해 직접 제공한 일체의 명칭 내지 상징물 등을 소유한다. 단, 제4(c)조에 규정된 사항을 예외로 한다.
b. 학회는 저널을 통해 직접 제공한 논평과 저널에 포함된 모든 기사에 대한 저작권 을 소유한다.
c. 본 계약에는 출판사 또는 제3자가 소유 내지 제공하거나 저널에 이용된 지적 재산에 대해 소유권을 주장할 권리를 학회가 부여 받은 것으로 해석되는 내용이 포함되지 않는다.
d. 출판사는 비용을 부담하여 학회의 명의로 각 저널 발행물에 대한 저작권을 세계 전역에 등록하고, 각 저널 발행물에 대한 저작권을 고지하는 통지문을 적합하게 발행해야 한다. 각 저작권 통지문은 학회가 저작권을 소유함을 나타내고, 국제 저작권 협정 (Universal Copyright Convention; UCC)에 부합해야 한다. 출판사는 저널 기사의 디지털 객체 식별자 (Digital Object Identifier; DOI)를 할당, 등록해야 한다.
5. 부여된 권리
a. 학회는 본 계약 기간 동안 세계 전역에서 현재 알려졌거나 이후에 개발 내지 완성되는 모든 매체, 형태 및 언어 로 저널을 제작, 출판, 파일 보관, 번역, 판매할 배타적인 권리와 라이선스를 출판사에 부여하며, 당해 권리와 라이선스는58권 (2015)부터 실행된다.
b. 본 계약의 조건에 따라 학회는 본 계약 기간 동안 학회의 이름과 저널의 제목은 물론 이들에 연계된 상표, 상표명, 심벌 마크 등을 이용할 배타적인 라이선스를 출판사에 부여한다. 전술한 배타적인 라이선스는 출판사가 본 계약에서 부여 받은 권리의 행사와 관련되며, 저널 출간인으로서 권리를 추구하는 과정에서 적정하게 실행된다 .
c. 학회는 과거에 저널에 게재될 수 있었던 학회 뉴스, 논평 및 기타 자료를 인쇄 및 전자 형태로 복제할 비배타적 권리를 갖는다. 단, 동료 점검 기사를 제외한다 . 학회는 저널 판매를 통해 발생하는 수입이 전용되거나 세계적인 출판 프로그램을 적용하여 저널을 판매하는 출판사의 능력이 훼손될 수 있는 방식으로 자료를 이용하지 않는다. 또한 학회는 출판사의 승인 없이 자료를 배포하기 위해 제3자 기금 또는 제3자 참여를 모색하지 않는다. 출판사는 불합리하게 승인을 보류해서는 안 된다 .
d. 출판사가 재고를 확보하지 못하는 경우 학회는 유효한 구독자의 요구를 충족하고, 과거 단행본의 이월 주문을 처리할 수 있도록 자료를 단일 발행물로 간행할 권리를 출판사에 부여한다. 상기 발행물의 판매로 발생한 수익은 제16조에 명시된 순수익에 포함된다.
e. 디지털 보존 기관: 양 당사자는 출판 계약 기간 동안 출간되는 저널 내용을 파일로 보관하기 위해 Portico (www.portico.org)와 같은 디지털 보관 기관(또는 이와 유사한 성질을 갖는 보관소 내지 이후에 고안되거나 완성되는 새로운 파일 보관 방식을 개발하는 기타 회사와 공동 운영되는 보관소)에 위탁하는 권한을 출판사에게 부여하기로 합의한다.
6. 부차권
출판사는 저널의 전부 또는 일부를 임의의 언어로 번역, 인가, 발췌, 개조할 권리는 물론 저널에 연계된 부차적인 권리를 현재 알려졌거나 이후에 고안 또는 완성되는 형태와 서식으로 실행하는 권리를 제3자에게 허가하는 배타적인 권리를 가져야 한다. 출판사는 전술한 권리를 행사하는 하위 라이선시로서 높은 품질 기준을 유지하는 기관을 선정하기 위한 적정한 상업적인 노력을 기울여야 한다. 출판사는 요청이 있으면 전술한 권리의 행사에 대해 학회에 통지해야 한다.
7. 상충되는 저작물
a. 학회는 본 계약 기간 동안 출판사가 저널의 성공적인 출간과 직접적으로 충돌하거나 경합하는 것으로 판단하는 다른 전문지 또는 업계지와 새롭게 제휴를 맺거나 동료 검토, 전문지, 전문 잡지 등의 출간에 공식적으로 관여하지 않는다.
b. 학회는 본 계약 기간 동안 합법적으로 가능한 범위 내에서 출판사 이외의 다른 당사자가 출간한 유사 내용 내지 특성의 잡지를 위해 기존과 유사한 역할을 수행할 것을 저널의 편집장에게 허용해서는 안 된다. 그러나 출판사는 저널의 편집장이 다른 잡지의 편집국에서 근무할 수 있음을 인지해야 한다.
