제2조 가 격
① 합의된 작품의 구매가격은 금 원(￦ )(세금포함)이다.
② “을”은 “갑”에게 위의 작품에 대한 정당한 소유권이 있음을 보증한다.
③ 대금지급일은 계약체결일로부터 15일 이내로 한다.
제3조 납 품
① 상기작품은 2014. . . 까지 “갑”에게 인수인계 되어야 하며, 인수인계 장소는 서울 시립미술관 수장고(서울시 중구 덕수궁길 61 소재)로 한다.
② 기타의 사유로 인해 납품 일시를 변경하고자 할 경우, “을”은 “갑”과 협의 하여 조정 할 수 있다.
제4조 저작권 사용
① “을”은 상기작품에 대한『저작권 사용권한』(전시권, 출판권, 복제권, 전송권, 공연권, 방송배포권, 2차 저작물 제작권 등의)을 “갑”에게 허락 한다. 다만 작품성의 본질적인 내용 변경에 관한 사항은 그러하지 않다.
② “갑”은 상기작품의 저작인격권을 최대한 존중하여야 한다.
제5조 관련자료 제공
“을”은 상기작품 각 점에 대한 진품보증서, 작품내역서, 작품이력서 등을 “갑”에게 제공한다.
제6조 안전관리 및 상태검사
“갑”과 “을”은 작품 해포시 공동으로 입회하여 작품의 보존상태 등 제반사항을 점검, 확인하여 작품의 인수인계를 필한다.
제7조 사후관리 및 협력
① 을은 위의 작품에 대해 납품일로부터 1년 동안 하자에 대한 책임을 진다.
② 갑은 필요시 작품의 설치 및 보존관리 등에 관련된 업무를 을에게 요청할 수 있다.
제8조 비밀의 준수
“갑”과 “을”은 계약 이행의 전후를 막론하고 당해 계약을 통해서 얻은 모든 사항에 대하여 비밀 을 상호 준수하여야 한다.
제9조 기 타
① 본 계약에 규정되지 않은 사항은 당사자 간의 합의로써 결정한다.
② “갑”과 “을”은 상기 계약내용을 확인, 증명하기 위하여 본 계약조건 2부를 작성하고, “갑”과 “을”이 각각 서명 날인한 후 각 1부씩 보관한다. |

Article 2 Price
① The price of the agreed artwork is won (￦ )(including tax).
② “B” guarantees that “A” has lawful ownership over the above artwork.
③ The payment must be made within 15 days after the contract is signed.
Article 3 Delivery
① The artwork stated above must be transferred to “A” by 2014. . . , and the location for its delivery is the Seoul Museum of Art Storage(61 Deoksugung-gil, Jung-gu, Seoul).
② When wishing to change the delivery date for other reasons, “B” can make adjustments by discussing with “A”.
Article 4 Copyright usage
① “B” must permit『Right to use copyright』for the above artwork to “A”(Exhibition right, print right, right to reproduce, right to transmit, performance right, broadcasting right, right to create secondary work etc.). However, this does not apply to changing the fundamental value of the work.
② “A” must respect the artist’s moral right of the above artwork as much as possible.
Article 5 Relevant Materials
“B” must provide the warranty, artwork statement, and artwork record to “A”.
Article 6 Safety Management and Status Check
“A” and “B” must be present together when unpacking the artwork, inspect general details such as the preservation state of the artwork and hand over the piece.
Article 7 Follow-up Management and Cooperation
① “B” assumes responsibility for defects on the above artwork for a year after the
delivery date.
② “A” can request tasks related to installation or preservation management of the artwork to “B” when necessary.
Article 8 Confidentiality
“A” and “B” must mutually maintain confidentiality on all issues obtained through the contract whether before or after executing the contract
Article 9 Miscellaneous
① Issues that are not regulated by this contract shall be decided through agreement
between the parties.
② “A” and “B” must confirm the content of the above contract, write two copies of the
contract condition as proof, and “A” and “B” store a copy respectively after signing
the contract. |
