경매정보 번역(한국어 원본) 효율적인 부동산 경매정보 제공방안
– 집행관의 현황조사와 매각물건명세서를 중심으로 –
본 연구는 2002. 7. 1. 시행된 민사집행법 제 9 조와 제 112 조에서 매각 기일에 매각물건 명세서 · 현황 조사 보고서 및 감정 평가서의 각 사본만을 열람할 수 있도록 하고, 집행기록에 대한 일반인들의 열람을 불허함으로써 부동산경매에 있어서 매각물건명세서 제도의 기능과 역할이 증대된 바, 실제 경매시장에서의 매각물건명세서와 집행관의 현황 조사 보고서 등이 그 본연의 기능을 하고 있는지 파악하고자 하는 필요성에서 시도되었다.
매각물건명세서에는 일반 매수 참가자들이 쉽게 알 수 있도록 부동산의 현상, 점유관계, 차임 또는 보증금의 액수, 그 밖의 현황이 기록되는데, 이는 집행법원의 명령을 받은 집행관들에 의해 조사되고 있으며, 일반 매수 참가자들이 열람을 할 수 있도록 하고 있다. 매각물건명세서 제도의 취지는 매수희망자에게 매각물건에 대한 필요한 정보를 쉽게 얻을 수 있게 하고 예측하지 못한 손해를 미연에 방지하는데 있으며, 경매의 주 목적은 적정가격에 매수자와 채무자 그리고 채권자의 목적을 달성하는 것이라 할 수 있다. 하지만, 현행 현황조사제도와 매각물건명세서의 운영방식은 본래의 취지를 살리지 못하고 있을 뿐만 아니라, 오히려 경제적, 시간적인 피해가 발생하고 있어서 경매의 주목적의 취지 또한 살리지 못하고 있는 것이 현실이다. 따라서 이러한 피해의 방지를 위한 집행관의 현황조사와 이를 근거로 한 매각물건명세서의 중요성은 더욱 커질 것으로 보인다.
본 연구는 집행관들에 의한 현황조사와 매각물건명세서의 정보 기재 그리고 경매절차의 문제점을 파악하고 그 해결점을 제시함으로써 민사집행의 목적과 이상인 집행절차의 대중화, 권리의 신속한 실현 그리고 집행 목적물의 적정한 매각을 이룰 수 있도록 하고자 한다. |

– Focused on the bailiff’s status investigation and the statement of the property being auctioned –
By the enactment of civil justice article 9 and 112 on the 1st Jul 2002, that enforced the disclosure of the copy only of the statement of the property subject for the auction, its status report and the appraisal on the day of the auction and prohibiting the disclosure to the public, the role and the function of the statement of the auctioned property became ever more important. Therefore, this study was carried out because of the need to understand whether the auctioned property’s statement and the bailiff’s status investigation report are carrying out their roles and responsibilities appropriately in the auction market.
To allow the auction participants to easily access insight to the property, the auctioned property’s statement carries the records of property status, revenue gained from the property or the deposit amount, ownership relationships and other useful information. Such information is investigated by the bailiffs who are commissioned by the court and is also disclosed to the general auction participants. This system is to allow easy access to the information about the auctioned property for the potential buyers in order to prevent any unanticipated loss – this is to ensure that the true objective of auction procedure is properly observed; that is to satisfy the objectives of the buyer, debtor and the creditor at the right price. However, not only does the current system of property investigation and its statement suffice the original intention, it is even detrimental both in terms of economy and time. Therefore, in order to prevent such losses, the importance of property status investigation carried out by the bailiff and property statement based on such investigation will become even greater.
This study was carried out to identify problems on the bailiff’s status investigation and the recorded information about the property being auctioned, and the actual auction process and to propose resolutions to such problems so as to realize the true objectives of the civil justice, to carry out the law effectively, prompt realization of rights and the appropriate sale of the property. |
