협정서 번역(한국어 원본)제1조 목적
이 협정의 목적은 KR의 풍력발전시스템의 기술기준에 따른 제품인증을 위해 제2조에서 규정하는 성능평가 업무를 전문기관이 시행함에 있어서 그 성능평가 업무의 범위, 일반조건 및 기타 필요한 사항을 정하고자 하는 것이다.
제2조 성능평가 업무 시행범위
전문기관에 시행하는 성능평가 업무의 범위는 다음과 같다.

제3조 일반조건
1.전문기관은 제2조에서 정하는 성능평가 업무를 수행함에 있어 관련된 KR의 업무절차 및 지침에 따라 성능평가 업무를 수행해야 한다.
2.전문기관은 성능평가 업무를 수행하는데 필요한 내부규정을 갖추어야 하며, 풍력발전 시스템의 기술기준 및 관련 기술규칙에서 정하고 있는 제반 관련규정에 적합하게 성능평가 업무를 수행할 수 있는 능력을 갖추고 성능평가 업무를 수행해야 한다.
3.전문기관은 성능평가 업무의 능력과 관련하여 법률 및 규정에서 요구하는 자격조건(예, KOLAS 인정 등)을 갖추어야 하며, 이러한 자격조건을 갖추지 못한 경우 성능평가 업무와 관련한 KR의 내부절차에 따라 전문기관의 평가, 등록 및 사후평가 등을 위한 제반 업무에 협조해야 한다.
4.이 계약에 의거하여 전문기관이 수행하는 업무는 KR이 수행하는 업무와 동등한 것으로 인정하며, KR은 전문기관의 성능평가 결과에 대해 검증하고, 성능평가 결과의 활용 등에 대해 책임을 진다.
5.전문기관은 성능평가 결과 부적합의 발생 등 성능평가 업무 수행 중에 발생하는 일탈상황을 인지한 경우, 즉시 그 사실을 KR에 통보하여야 하며, 부적합의 조치 및 해결을 위해 KR 및 성능평가 신청자에게 적극 협조해야 한다.
6.KR 및 전문기관은 성능평가 업무를 수행함에 있어 관련 이해관계자에 대하여 다툼이나 분쟁 등이 발생하지 않도록 상호간에 적극 노력해야 한다.
제4조 규정의 해석
1.제품인증 및 성능평가 업무와 관련한 기준 및 기타 관련 규정의 해석에 있어 이견이 있는 경우 KR은 이를 검토하고 기술기준 및 국제규격 등에 적합하도록 결정하여 전문기관에 통보해야 한다.
2. 전문기관은 관련규정의 적용에 있어 적용의 면제, 관련 규정에 대한 다른 적용이 필요한 경우 KR에 문서로서 통보하고, KR의 승인을 받아야 한다.
제5조 성능평가 업무
1.전문기관이 수행하는 성능평가 업무는 KR의 풍력발전시스템의 기술기준 및 관련 국내, 국제규격 등에서 명시하는 제반 관련규정에 적합해야 한다.
2. 전문기관은 제2조에서 정하는 성능평가 업무를 수행하는데 필요한 시스템을 수립, 유지해야한다.
3. 전문기관은 성능평가 결과 부적합의 발생 등 성능평가 업무 수행 중에 발생하는 일탈상황을 인지한 경우, 즉시 그 사실을 KR에 통보하여야 한다. |
협정서 번역(영어 번역본)Article 1 – Objectives
The goals of this agreement are to define the scope of performance evaluation process and other general conditions and necessary requirements for the Evaluator Agency in carrying out the performance evaluation processes defined in the article 2 of this agreement for product certification in accordance to the KR’s technical specification of wind turbine system.
Article 2 – Scope of Performance Evaluation Process
The scopes by which the Evaluator Agency will carry out the performance evaluation are as the following.

Article 3 – General Condition
1.In terms of carrying out the performance evaluation process defined in the article 2, the Evaluator Agency must abide by the related work processes and guidelines of KR.
2.Before carrying out the actual tasks, the Evaluator Agency must have in place necessary internal regulation in terms of carrying out the performance evaluation process, and must have the necessary capability and appropriate skills for performance evaluation process that is in accordance to the various required regulations set by the wind turbine system’s technical specification and other related technical regulations.
3.In terms of ability to carry out the performance evaluation process, the Evaluator Agency must be certified in terms of requirements requested by the law and other regulations (e.g. KOLAS Certification etc). If not certified in such ways, it must cooperate with various work involved such as when the Evaluator Agency it self is evaluated, registered and for the post evaluation process.
4.In regards to this agreement, it is acknowledged that the work carried out by the Evaluator Agency is equivalent to the tasks carried out by KR, and KR takes the responsibility of verifying the result of Evaluator Agency’s performance evaluation and the actual application of such result.
5.If and when the Evaluator Agency perceives any anomalies that occur during the performance evaluation process such as inappropriate performance evaluation results, it must immediately report such an occurrence to KR, and it must actively support to KR and to the evaluation requester for resolving such an occurrence.
6.In terms of carrying out the performance evaluation process, KR and the Evaluator Agency must cooperate with one another in order to avoid any disputes or disagreements.
Article 4 – Interpretation of Regulation
1.In the case where there are disagreements when interpreting the standards and other related regulations in relation to product certification and performance evaluation process, KR should review such items and make decisions based on and in compliance to the technical standard and international regulations and report to the Evaluator Agency.
2. In terms of applying the related regulation, if there are needs for different application of the regulation or exemption in application, the Evaluator Agency must report to KR in writing and obtain KR’s approval.
Article 5 – Performance Evaluation Process
1. The performance evaluation process carried out by the Evaluator Agency must be appropriate for KR’s wind turbine system technical standard and other related regulations that are defined by the local and international standards.
2. The Evaluator Agency must establish and maintain the system necessary for carrying out the performance evaluation process defined by the article 2.
3. The Evaluator Agency must report to KR immediately when it perceives any anomalies that occur during the performance evaluation process. |
