데이터관리 규정 번역(한국어 원본)

제2조 (용어의 정의) 본 규정에서 사용하는 용어의 정의는 다음과 같다.
1. “남극지역”이라 함은 남위 60° 이남의 육지ㆍ빙붕 및 수역과 그 상공을 말한다.
2. “북극지역”이라 함은 북위 66.5° 이북의 육지ㆍ빙붕 및 수역과 그 상공을 말한다.
3. “극지역”이라 함은 제1호와 제2호의 지역을 말한다.
4. “극지데이터”라 함은 극지역에서 수행된 극지연구의 전 과정에서 획득되는 유무형의 데이터와 이를 사용한 연구과정에서 획득되는 추가적인 데이터ㆍ정보 및 성과를 말한다(이하 “데이터”라 한다).
5. “메타데이터”라 함은 데이터의 설명에 필요한 데이터의 제목, 데이터 생산자, 데이터 내용 및 요약, 획득지역 및 시기, 데이터 포맷, 데이터 품질 등의 내용으로 구성되어 데이터를 설명하기 위해 사용되는 데이터를 말한다.
6. “원시데이터”라 함은 극지연구 과정에서 획득되어 획득당시 초기상태를 보존하고 있으며 어떠한 인위적 가공 또는 처리가 이뤄지지 않은 데이터를 말하며, 전자적인 형태로 저장된 디지털데이터와 생물ㆍ토양ㆍ암석ㆍ물ㆍ눈ㆍ얼음ㆍ공기 등과 같은 유무형의 아날로그데이터를 포함한다.
7. “처리데이터”라 함은 획득된 원시데이터 또는 다른 처리데이터를 연구목적의 달성을 위하여 분석기기ㆍ장치 또는 컴퓨터 등을 활용하여 분석ㆍ처리 또는 가공 등의 과정을 거쳐 획득되어 결과도출을 위하여 사용되는 데이터를 말한다.
8. “결과데이터”라 함은 원시데이터와 처리데이터를 사용하여 연구목적에 부합하도록 연구결과로 도출된 최종 데이터를 말한다.
9. “극지연구활동 책임자“라 함은 데이터의 획득 및 도출과 관련한 해당 연구사업의 책임자 또는 책임자로부터 권한과 의무을 위임받은 자를 말한다.

제3조 (소유권) 극지연구소에서 수행하는 연구사업으로 발주기관에서 데이터의 소유권에 대하여 언급하지 아니하였거나 소유권을 극지연구소에 위임하였을 때 또는 극지연구소에서 발주한 연구사업으로, 연구수행을 통해서 생산된 모든 데이터의 소유권은 극지연구소에 있다.

제4조 (관리대상) 본 규정을 통하여 관리되는 데이터는 메타데이터, 원시데이터, 처리데이터 및 결과데이터 등 극지연구를 통하여 획득되는 모든 유무형의 데이터를 포함한다.

제5조 (한국극지데이터센터) 데이터 관리를 총괄ㆍ조정하고 데이터의 영구보존, 관리, 공유 및 사용에 관한 제반업무는 한국극지데이터센터(이하 “데이터센터”라 한다)에서 수행한다.

제2장 데이터의 관리

제6조 (데이터관리계획의 수립 및 이행) 극지연구활동 책임자는 데이터관리계획을 수립하고, 수립된 데이터관리계획에 따라 데이터가 관리되도록 하여야 한다.
제7조 (메타데이터 등록) 극지연구활동 책임자는 데이터 획득 즉시 데이터센터에서 정한 요구사항에 따라 메타데이터를 작성하여 데이터센터에 등록하여야 한다.
제8조 (원시데이터 등록) 극지연구활동 책임자는 원시데이터가 획득되면 획득일을 기준으로 3개월 이내에 원본데이터를 데이터센터에 등록하여야 한다.
제9조 (처리데이터와 결과데이터 등록) 극지연구활동 책임자는 처리데이터 또는 결과데이터가 도출되면 획득일을 기준으로 3개월 이내에 처리데이터 또는 결과데이터를 데이터센터에 등록하여야 한다.
제10조 (데이터의 관리 및 보존) 데이터센터는 극지연구활동 책임자에 의해 등록된 메타데이터, 원시데이터, 처리데이터 및 결과데이터를 안전하게 관리ㆍ보존하여야 한다.

제3장 데이터의 공개 및 활용

제11조 (데이터 공개 및 활용의 원칙) 극지연구활동을 통해 획득된 모든 데이터는 과학적 목적의 자유로운 활용을 위해 공개함을 원칙으로 하며, 데이터센터는 온라인과 오프라인을 통하여 데이터가 공개되고 활용될 수 있도록 관련 체제를 구축ㆍ운영한다.

제12조 (데이터 보호) 데이터관리계획에 의거하여 데이터센터에 등록된 데이터는 극지연구활동 책임자의 추가요청에 의해 일정기간 동안 데이터를 공개하지 아니할 수 있다. 단, 데이터의 공개유보 결정은 별도의 승인에 의한다.

제13조 (데이터 공개) ① 데이터센터는, 데이터관리계획 등에 따라 공개시점이 도래하거나 극지연구활동 책임자가 공개를 요청한 데이터에 대하여 요청일로부터 14일 이내에 해당 데이터의 공개여부를 결정하여 온･오프라인으로 공개하여야 한다.
② 공개가 확정된 데이터는 효율적인 데이터 검색과 효과적인 데이터 활용을 위하여 남극자료주명부(AMD, Antarctic Master Directory)에 등록하여야 한다.

제14조 (데이터 활용) 데이터를 활용하고자 하는 자는 활용대상 데이터, 활용범위 및 목적이 포함된 활용신청서를 데이터센터에 신청하여야 하며, 데이터센터는 접수된 활용신청서를 검토하여 접수일로부터 14일 이내에 데이터의 활용 허가 여부를 통보하여야 한다.

제15조 (데이터 활용에 따른 의무) 데이터 활용자는 사전에 통보된 목적 및 범위에 한하여 데이터를 활용하여야 하며, 데이터를 활용한 결과에는 데이터센터에서 정한 기준에 따라 데이터의 출처를 명시하고 동 내용을 데이터센터에 보고하여야 한다.

제16조 (데이터 관리현황 보고) 데이터센터는 데이터의 등록, 열람 및 활용에 관한 현황을 작성․보고하여야 한다.

Article 2 (Definitions of Terms) The definitions of the terms used in this policy are as following.
1. The “Antarctic region” shall refer to landㆍice shelves, waters, and airspace south of 60° south latitude.
2. The “Arctic region” shall refer to landㆍice shelves, waters, and airspace north of 66.5° north latitude.
3. The “polar regions” shall refer to the areas of Clause 1 and Clause 2.
4. The “polar data” shall refer to tangible and intangible data acquired during all phases of polar research conducted in the polar region, and additional dataㆍinformation and results that are acquired in research procedures using these data. (Hereinafter referred to as the “Data”).
5. The “metadata” shall refer to data that is used to explain the Data and is consisted of the Data’s title, producer, content and summary, region and time at which the Data was acquired, format, and quality of the Data.
6. The “primitive data” shall refer to data that is acquired during polar research, preserves the initial state when acquired, and has not gone through any artificial treatment or processing. It includes digital data stored in electronic form and tangible and intangible analog data such as organismsㆍsoilㆍrocksㆍwaterㆍsnowㆍiceㆍair.
7. The “processed data” shall refer to the data that is acquired by analyzingㆍtreating or processing acquired primitive data or other processed data using analytical instrumentsㆍdevices or computers in order to achieve the research objectives and is used to deduce results.
8. The “result data” shall refer to the final data drawn from research results using primitive data and processed data to conform with the research objectives.
9. The “polar research activities manager“ refers to the person in charge of the research business in terms of acquiring and deducing data or the person who has been entrusted with authorities and obligations by the manager.

Article 3 (Ownership) For research businesses conducted by KOPRI where the outsourcing organization did not mention data ownership, entrusted ownership to KOPRI, or outsourced by KOPRI, all Data produced through conducting research belongs to KOPRI.

Article 4 (Subjects of Management) The Data managed through this policy include all tangible and intangible data that is acquired through polar research such as metadata, primitive data, processed data and result data.

Article 5 (Korea Polar Data Centre) The Korea Polar Data Centre (hereinafter, referred to as the “Data Centre”) oversees ㆍmediates data management and conducts various duties on the permanent preservation, management, sharing and usage of data.

Chapter 2 Data Management

Article 6 (Establishment and Implementation of Data Management Plan) The polar research activities manager establishes a data management plan, and ensures that the Data is managed based on the established data management plan.
Article 7 (Metadata Registration) If the Data is acquired, the polar research activities manager shall immediately write the metadata based on the requirements defined by the Data Centre and register in the Data Centre.
Article 8 (Primitive Data Registration) If a primitive data is acquired, the polar research activities manager shall register the primitive data in the Data Centre within 3 months from the acquired date.
Article 9 (Processed Data and Result Data Registration) If a processed data or result data is deduced, the polar research activities manager shall register it in the Data Centre within 3 months from the acquired date.
Article 10 (Data Management and Storage) The Data Centre shall safely manageㆍstore the metadata, primitive data, processed data and result data registered by the polar research activities manager.

Chapter 3 Data Disclosure and Utilization

Article 11 (Principle of Data Disclosure and Utilization) In principle, all data acquired through polar research activities are disclosed for the free utilization of scientific purpose. The Data Centre shall establishㆍoperate relevant system such that data can be disclosed and used both online and offline.

Article 12 (Data Protection) In accordance with the data management plan, the Data registered in the Data Centre may not be disclosed for a certain period of time based on the additional request of the polar research activities manager. However, the decision to defer disclosure of data is based on a separate approval.

Article 13 (Data Disclosure) ① For Data that has reached its disclosure time according to the data management plan or requested by the polar research activities manager to be disclosed, the Data Centre must decide whether or not to disclose the Data and announce it online･offline within 14 days from the requested date.
② The Data to be disclosed shall be registered in the Antarctic Master Directory (AMD) for efficient data search and effective data usage.

Article 14 (Data Utilization) Those who intend to utilize the Data must submit a usage application that includes the Data that he plans to utilize, the scope and purpose of usage to the Data Centre, and the Data Centre shall review the registered usage application and notify data usage permission status within 14 days from the date of registration.

Article 15 (Obligations for Data Utilization) The data user shall use the Data within the extent of the purpose and scope notified in advance, and shall state the data source on the result that used the data based on the standard decided by the Data Centre and report the same content to the Data Centre.

Article 16 (Data Management Report) The Data Centre shall write․report the status of data registration, reading, and usage.
