금융과 지식산업 분야에서 유럽의 관문으로 볼 수 있는 ‘영국’은 그 위상에 비해 한국에는 잘 알려져 있지 않을 것이 사실이며, 외국 변호사를 꿈꾸는 많은 한국 변리사들이 미국 변호사를 지원하는 것도 사실입니다. 또한 최근 삼성전자, 현대자동차 등 한국 기업들의 미국 등 해외 시장 진출이 확대되면서, 미국에서 한국 변리사 수요가 증가하고 있으며, 이에 따라 공급도 늘어나고 있습니다. 이에 반해 영국을 포함한 유럽연합(EU)에 전문성을 가진 변리사나 변호사는 시장의 수요에 비해 충분하지 않으며, 특히 향후 한국 기업들의 영국과 유럽시장 진출 확대에 따라 변리사와 변호사 수요는 더욱 증가할 것으로 기대됩니다.

어떻게 준비하고 이룰 것인가?

학부에서 건축공학을 공부하고, MBA 과정을 거쳐 CJ그룹에서 기획업무를 담당하였으며, 이후 변리사 자격 취득을 위해 약 3년의 기간 동안 특허법 등 지식재산권 분야 법에 대한 공부를 하였으며, 변리사 자격 취득 이후에도 공부한 기술가치평가사 자격과 금융분야에 대한 전문성을 인정받아 2012년 6월에는 국내 대표적인 ‘IBK기업은행’에 전문인력으로 입사하기도 하였습니다.

또한 삼성그룹과 CJ그룹, 기업은행 등 한국 기업들은 물론 한국 특허청과 중소기업청과 한국발명진흥회 등 다양한 공공기관은 물론 한국의 법무법인과 특허법인 실무 담당자들과의 네트워크를 활용하여 향후 영국을 포함한 유럽의 기업들과 연계 비즈니스를 창출하고 경제적 효과를 창출해 나갈 수 있을 것입니다.

The reason why a Korean patent attorney dreams of becoming a lawyer

Recently, an issue called ‘creative economy’ which seeks for new growth opportunities based on ideas and innovation has received some attention in Korea. It can be analyzed as a change the paradigm from IP (Intellectual Property) such as patent to one of the core assets of tertiary service industries from the perspective of protecting secondary industries. An example of this movement is that many financial institutions including the bank for which I am working have developed and sold a variety of IP-based finance products and invested for businesses which hold good IP.

I am working for IBK, one of the government-run banks in Korea, as a patent attorney and am in charge of patent application consultations to protect the technologies and ideas held by many companies and value evaluations for IP including patents. I fully understand the many important issues about the creation, protection and utilization of IP through my experiences such as patent application, examination and litigation at law firms and patent firms and have the service competitive power to meet the needs of demanding companies.

However, as business, technology and ideas are converged and become more and more sophisticated and the needs of businesses are diversified, it is required to have the knowledge of laws such as the Unfair Competition Prevention Act, Civil Procedure Act and Criminal Procedure Act, not to mention laws related to IP including patents. Working-level experience is also required. I think that the times call for lawyers who can give support of the ‘perspective of using corporate assets’ so as to solve problems of highly developed and complicated businesses, based on the knowledge and service of the ‘perspective of creating IP’ held by patent attorneys in the past.

I dream of becoming a lawyer who can give both consultations and create solutions for the many legal problems of businesses including those related to IP.

Why do I dream of becoming an English lawyer?

It is true that compared with its status, the United Kingdom, the gateway to Europe in the field of financial and IP industries, is not well known in Korea and it is also true that many Korean patent attorneys who dream of becoming lawyers in foreign countries apply to be American lawyers. Also, with the expansion of entry of Korean companies such as Samsung Electronics and Hyundai Motor Company to overseas markets including the American market, there is an increasing demand for Korean patent attorneys in the United States, which brought about an increasing supply of them. On the contrary, there are not enough professional patent attorneys or lawyers in the European Union including the United Kingdom compared with market demand and demand for both professions is expected to increase more and more as the entry of Korean companies into the markets of the United Kingdom and Europe expands.

I also think that ideas, technology and cultural content, the key intangible assets of Korea companies, have the potential to combine the various cultural bases of the United Kingdom and Europe and develop further and as a result, the importance of experts of English and European laws related to IP would grow more and more crucial.

This is the reason that I dream of becoming a lawyer in the United Kingdom, the gateway to Europe.

So, how should I prepare for and accomplish my dream?

I can grow into an English lawyer through the passion and effort for learning and through networks in Korea.

I majored in architectural engineering during my undergraduate studies and completed an MBA course. I entered the CJ Group and was in charge of planning. Then I studied IP laws such as patent law for three years to qualify as a patent attorney. After that, I was recognized to have the expertise for the qualifications of a technology valuation assessor and financial field and entered IBK, a representative bank of Korea, as a specialist in June 2012.

I could create business connected to the companies in Europe including the United Kingdom and create economic effects using the network with the working group of Korean law firms and patent firms, many public agencies such as the Korean Intellectual Property Office, the Small and Medium Business Administration, and the Korea Invention Promotion Association, as well as Korean companies including the Samsung Group, the CJ Group and IBK.

For this, I will learn the laws of the United Kingdom and practical business with a humble attitude and conceive business which can create a synergy effect among Korean, English and European companies and come up with methodologies for preventing and solving legal disputes.
